He was elected on March 21, 1995, to serve the remaining term of Judge Randall Bell, who passed away before taking office. Burnett won the election against Judge Costa Pleicones with a vote count of 102–58. Notably, in 1982, he presided over the trial of Edward Lee Elmore, a case later highlighted by journalist Raymond Bonner in his book 'Anatomy of Injustice: A Murder Case Gone Wrong' for its wrongful conviction issues.
